What Oklahoma needs first

What Oklahoma requires once you have the EIN
- Register with the Oklahoma Tax Commission through the OkTAP online business registration for the permits and accounts the LLC needs, such as a sales tax permit or a withholding account. The Tax Commission requires the federal EIN before a business can register.
- File the LLC annual certificate with the Secretary of State every year on the anniversary date of the LLC's registration, online or on paper, identified by the LLC's filing number.
- If the LLC has employees, open a withholding account with the Oklahoma Tax Commission and an unemployment tax account with the Oklahoma Employment Security Commission.
What is actually different about Oklahoma
- Oklahoma's yearly LLC filing is an annual certificate rather than an annual report, and it is due on the anniversary of the LLC's registration rather than on one statewide date. It confirms the LLC is active and gives its principal address and a contact email, which the Secretary of State requires in order to send future notices; an LLC that has not filed within 60 days after the due date stops being in good standing.
- The Oklahoma Tax Commission's registration instructions say an EIN is required before registering a business with the state, and they list limited liability companies among the businesses that must have one whether or not they pay wages. A single-member LLC with no employees still needs its own EIN to open Oklahoma tax accounts.
- An Oklahoma sales tax permit is issued first as a probationary permit, and it renews only if the business has reported and paid on time. The Tax Commission will not renew a probationary permit while the owners or members are delinquent in filing or paying Oklahoma taxes, so an LLC's permit can depend on its members' own tax standing.
