How to Apply for an EIN in Texas

The EIN application is federal and identical in every state. There is no Texas EIN, no Texas form, and no Texas office involved: you file IRS Form SS-4 and the IRS issues the number. What is genuinely different in Texas is what happens on either side of it — the Texas Secretary of State filing that has to exist first, and the state registrations that need the EIN once you have it.

What Texas needs first

Form your entity with the Texas Secretary of State before applying. The IRS asks for the legal name and formation date exactly as the state recorded them, and a mismatch is one of the common causes of a rejected application.

Texas issues a filing number — they look like 0806770615. It identifies your company in state records and is not a tax ID. It cannot be used where an EIN is asked for, and the IRS has no record of it.

What Texas requires once you have the EIN

  • Set up your account with the Texas Comptroller for franchise tax — Texas LLCs report annually even in years when no tax is owed.
  • Register for sales and use tax with the Comptroller if you sell taxable goods or services.

What is actually different about Texas

  • Texas is a community property state. A Texas LLC owned only by a married couple can elect to be treated as a disregarded entity rather than a partnership, which changes the tax classification you put on the SS-4 and removes an annual 1065 filing. In a non-community-property state the same two-member LLC has no such choice.
  • Texas has no personal income tax but does have a franchise tax, so the state relationship a Texas LLC has after getting its EIN is with the Comptroller rather than an income tax agency.
  • The Secretary of State issues a ten-digit filing number with leading zeros. It identifies the company in Texas records only and has no relationship to the federal EIN.

If you own the LLC with your spouse and no one else: Texas is a community property state, so you may treat the LLC as a disregarded entity instead of a partnership.
