What Arkansas needs first

Arkansas assigns its own filing number. It identifies your company in state records and is not a tax ID. It cannot be used where an EIN is asked for, and the IRS has no record of it.
What Arkansas requires once you have the EIN
- Register with the Arkansas Department of Finance and Administration through the Arkansas Taxpayer Access Point (ATAP) for the state tax accounts the business needs, such as a sales tax permit; the Department directs businesses not already filing in Arkansas to register for state taxes there.
- File the Annual LLC Franchise Tax Report with the Secretary of State on or before May 1 every year. Each report covers the calendar year that ended the previous December 31, so an LLC formed this year files its first report by May 1 of next year.
What is actually different about Arkansas
- Arkansas LLCs do not file a separate annual report. The annual franchise tax report, filed with and paid to the Secretary of State rather than the tax department, serves as the annual report, and it is due on or before May 1 with no extensions; Arkansas eliminated franchise tax extensions by statute in 1991.
- The Secretary of State's online franchise tax system asks for two things: the LLC's filing number and the federal tax ID on file with the Secretary of State. A company in its first year to file, or with no EIN on record yet, enters nine zeros instead, and the paper report carries its own Federal Tax ID line for the EIN.
- Arkansas franchise tax keeps accruing even after the state revokes an LLC for not paying, and it continues until the company is formally dissolved, withdrawn or merged. Under Arkansas law the Secretary of State also refuses other business filings from an entity that has not paid, so an LLC that is simply abandoned keeps running up a balance.
