Questions

When is Form 2553 due?

Within 2 months and 15 days of the start of the tax year the election should take effect, or at any time in the tax year before. Late elections may qualify for relief, which is what line I is for.

Who has to sign?

An officer signs Part I, and every shareholder signs the consent statement on page 2. Missing consents are a common reason an election is rejected.

Can an LLC use Form 2553?

Yes. An eligible LLC that files Form 2553 is treated as electing to be taxed as a corporation too, so it usually does not also need Form 8832.

Where do I send it?

By fax or mail to the IRS address for your state, listed in the Form 2553 instructions. Our guide to the Form 2553 fax number has them.

Is what I type here saved?

No. The form is filled in your browser and nothing you type is sent to us or saved.
