What New Hampshire needs first

New Hampshire assigns its own business ID. It identifies your company in state records and is not a tax ID. It cannot be used where an EIN is asked for, and the IRS has no record of it.

What New Hampshire requires once you have the EIN

  • File the annual report with the Secretary of State through NH QuickStart by April 1 every year, starting the year after the LLC registers.
  • Once the LLC's gross business income or enterprise value tax base passes the state's filing thresholds, file Business Profits Tax and Business Enterprise Tax returns with the New Hampshire Department of Revenue Administration, which takes returns and payments through Granite Tax Connect.
  • Before opening a hotel, offering sleeping accommodations, selling taxable meals or renting motor vehicles, apply for a Meals and Rooms (Rentals) operator's license from the Department of Revenue Administration through Granite Tax Connect.

What is actually different about New Hampshire

  • New Hampshire has no general sales tax on goods, so most New Hampshire LLCs never open a sales tax account. The state taxes the business itself instead: the Business Profits Tax on profits, and the Business Enterprise Tax, which is measured on the compensation, interest and dividends a business pays rather than on its profit.
  • New Hampshire taxes an LLC as its own business organization even when the IRS does not. A single-member LLC owned by an individual and disregarded for federal purposes still files its own New Hampshire return, Form NH-1040, the Proprietorship Business Profits Tax return, once it meets the filing requirements; S corporations are likewise taxed the same as C corporations.
  • The Department of Revenue Administration wants a separate identifying number on every business tax return. A single-member LLC that must file and has no EIN of its own has to apply for a Department Identification Number (DIN) through Granite Tax Connect or on Form DP-200, and may not file under the owner's Social Security number in the meantime.
