How to Apply for an EIN in Virginia

Last updated August 29, 2026 · Written by the EIN Registration filing team

The EIN application is federal and identical in every state. There is no Virginia EIN, no Virginia form, and no Virginia office involved: you file IRS Form SS-4 and the IRS issues the number. What is genuinely different in Virginia is what happens on either side of it — the Virginia State Corporation Commission (Clerk's Information System) filing that has to exist first, and the state registrations that need the EIN once you have it.

The EIN step itself

One federal form, one agency, the same options wherever the business sits: online, fax, mail, or the international phone line. The method decides the timeline, not the state. Every method and what it actually takes covers that in full, and it applies to Virginia unchanged.

What Virginia needs first

Form your entity with the Virginia State Corporation Commission (Clerk's Information System) before applying. The IRS asks for the legal name and formation date exactly as the state recorded them, and a mismatch is one of the common causes of a rejected application.

Virginia issues a SCC entity ID. It identifies your company in state records and is not a tax ID. It cannot be used where an EIN is asked for, and the IRS has no record of it.

What Virginia requires once you have the EIN

  • Register with Virginia Tax for sales and use tax or employer withholding — the EIN is required to open the account.
  • Pay the LLC's annual registration fee to the State Corporation Commission by the last day of the anniversary month, every year the company exists.

What is actually different about Virginia

  • Virginia business filings sit with the State Corporation Commission, a regulatory body that also oversees utilities and insurers, rather than with the Secretary of the Commonwealth. Owners searching for a Virginia Secretary of State business lookup land on the wrong office.
  • Virginia LLCs do not file an annual report with the state. They pay an annual registration fee instead, due in the anniversary month, and the company can be cancelled for missing it. An EIN cannot bring a cancelled LLC back.
  • The Commission issues an SCC entity ID that indexes the company in the Clerk's Information System. It is a state record locator, not a tax number, and Virginia Tax will still ask for the federal EIN.
