Does a Single-Member LLC Need an EIN?

Banks title an LLC’s account to the LLC, and their onboarding asks for the LLC’s taxpayer number. A few accept the owner’s SSN for a disregarded LLC. Most do not, because the account is in a company’s name and the company has no SSN. The same is true of most payment processors, merchant accounts and business credit applications.
So the honest answer is that a single-member LLC nearly always needs an EIN, whatever the IRS rule says about LLCs with no employees. The people who skip it tend to come back for it within the month.
What the IRS rule says
A single-member LLC that has not elected to be taxed as a corporation is a disregarded entity for federal income tax. That means the IRS looks straight through it to the owner. The LLC files no return of its own; the owner reports the business on Schedule C, or Schedule E for rentals, under their own Social Security number.
The IRS rule for EINs follows from that: a disregarded single-member LLC with no employees and no excise tax liability may use the owner’s SSN for federal tax purposes. That is the whole of the exception, and the bank is not bound by it.
When it stops being optional
- You hire an employee. Any employee, from the first payroll. The LLC then files employment returns under its own EIN even though its income tax still flows to you.
- You elect S corporation or C corporation status. The election forms themselves ask for the EIN, and the LLC then files its own return.
- You add a second member. The LLC becomes a partnership for tax purposes, which is on the mandatory list. It also generally needs a new EIN, not the old one.
- You owe excise tax or take on a retirement plan for the business.
What goes on the SS-4 for a single-member LLC
- Line 1. The LLC’s legal name, exactly as the state approved it, including the LLC suffix.
- Line 7a and 7b. You, as responsible party, with your SSN or ITIN.
- Line 8a to 8c. Yes it is an LLC, one member, and whether it was organised in the United States.
- Line 9a. This is the trap. A single-member LLC that wants default treatment ticks Other and writes “Disregarded entity” with the owner’s name. Ticking Sole proprietor puts the EIN on you personally rather than on the LLC; ticking Corporation is read as an election you may not have meant to make.
- Line 11. The date the LLC was formed, as the state recorded it.
The online IRS tool asks these as a series of questions and accepts whatever you pick. An EIN issued under the wrong classification is valid and wrong at the same time, and it surfaces when the first return is prepared.
The LLC has to exist first
Apply after the state approves the LLC, not before. The IRS wants the LLC’s legal name and formation date as the state recorded them, and an EIN obtained under a name the state later rejects belongs to nothing. Quick answers
I already had an EIN as a sole proprietor. Can the LLC use it?
No. The IRS says a new LLC needs its own EIN even when the same person was previously operating as a sole proprietor with one. The old number stays with the sole proprietorship.
Do I need a separate EIN for each single-member LLC I own?
Yes, if each one opens its own bank account or hires. Each LLC is a separate entity with its own number.
Does getting an EIN change how my LLC is taxed?
No. The classification on Line 9a is what matters, and choosing “disregarded entity” keeps everything on your personal return. The EIN is just the number.
