DBA stands for “doing business as”. Some states call it a fictitious name, an assumed name, or a trade name. Registering one tells the county or state that a particular person or company is trading under a name that is not their legal name. It does not create a new legal person. It does not create a taxpayer. It is a label.
The IRS issues EINs to taxpayers. So the EIN question is never “does the DBA need one”. It is “does the person or entity behind the DBA need one”, and that depends on what they are.
Sole proprietor with a DBA
You are the taxpayer. The rules for sole proprietors apply: no EIN is required unless you have employees, and most get one anyway for the bank and for W-9s. When a sole proprietor needs an EIN. On the SS-4, your own name goes on Line 1 and the DBA goes on Line 2. The EIN is issued to you, and you use it for every DBA you ever register.
LLC or corporation with a DBA
The entity is the taxpayer and already has, or needs, its own EIN. A DBA the LLC registers afterwards is a trade name of the LLC. It uses the LLC’s EIN. An LLC running three product lines under three DBAs has one EIN and one return. If the LLC has not obtained its EIN yet, it applies in the LLC’s legal name with the DBA on Line 2.
The mistake that creates two numbers
The common error is applying for a second EIN when a DBA is registered, on the theory that a new name needs a new number. The IRS will issue it, because the online tool does not check whether you already have one. The result is a person or entity with two EINs, 1099s arriving under both, and a bank account under one while returns are filed under the other. Order of operations
For a sole proprietor the DBA and the EIN are independent. Either can come first. Some banks want to see the DBA registration before they will open an account under the trade name, and the EIN application does not require it, so the practical order is usually DBA, then EIN, then bank.
For an LLC, the LLC comes first, then the EIN in the LLC’s name, then any DBA. EIN before or after the LLC explains why that order is not optional.
