How to Apply for an EIN in Nevada

The EIN application is federal and identical in every state. There is no Nevada EIN, no Nevada form, and no Nevada office involved: you file IRS Form SS-4 and the IRS issues the number. What is genuinely different in Nevada is what happens on either side of it — the Nevada Secretary of State filing that has to exist first, and the state registrations that need the EIN once you have it.

What Nevada needs first

Form your entity with the Nevada Secretary of State before applying. The IRS asks for the legal name and formation date exactly as the state recorded them, and a mismatch is one of the common causes of a rejected application.

Nevada assigns its own entity number. It identifies your company in state records and is not a tax ID. It cannot be used where an EIN is asked for, and the IRS has no record of it.

What Nevada requires once you have the EIN

  • Register with the Nevada Department of Taxation through the Nevada Tax Center — the sales tax permit, and the modified business tax account once you have employees, both ask for the EIN.
  • File the annual list of managers or members and renew the state business license with the Secretary of State by the end of the anniversary month each year.

What is actually different about Nevada

  • Nevada formation is three filings at once: the articles of organization, the initial list of managers or managing members, and the state business license, all submitted together through the SilverFlume portal. An LLC whose owner filed only the articles is not complete and will not show as active.
  • Nevada's state business license is issued by the Secretary of State as part of the formation bundle, not by the Department of Taxation, and it renews annually with the list of managers. The Department of Taxation handles sales tax and the modified business tax on payroll separately, under the federal EIN.
  • Nevada has no personal or corporate income tax, but it does have a commerce tax on Nevada gross revenue above a threshold and a modified business tax on wages. Both are registered and filed with the Department of Taxation, so a Nevada LLC with employees ends up with accounts at two state agencies plus the IRS.

If you own the LLC with your spouse and no one else: Nevada is a community property state, so you may treat the LLC as a disregarded entity instead of a partnership.
