- A business bank account. Virtually every U.S. bank requires an EIN to open an account for an LLC or corporation, even in cases where the IRS itself does not require the entity to have one. No EIN means no account and no clean separation between business and personal money.
- Hiring employees. Payroll, W-2s, quarterly 941s, and employment tax deposits all run on the EIN. It is the literal “Employer” in the name, and you need it before the first hire, not after.
- Filing business tax returns. Corporations file Form 1120, S corps file 1120-S, and partnerships and LLCs with multiple members file 1065, all under the EIN and never under anyone’s SSN.
- Business licenses and permits. State and local license applications, sales tax registrations, and industry permits almost universally ask for it.
- Building business credit. Business credit cards, net 30 vendor accounts, and business loans are underwritten against the EIN’s credit file, a file that does not exist until there is an EIN to anchor it.
- Keeping your SSN private. Every client who pays you $600 or more asks for a W-9. With an EIN, that form carries the business number instead of your Social Security Number. That is one less copy of your SSN sitting in strangers’ files.
- Certain retirement plans. A Solo 401(k) or Keogh plan for the self employed requires one, even with zero employees.

EIN vs SSN vs ITIN: which number does what?

Does an LLC need an EIN?
An LLC with two or more members always does, since it files a partnership return under the EIN. A single member LLC with no employees and default tax status is not required to have one by the IRS, but in practice gets one anyway: the bank requires it, W-9 privacy is the whole point, and running an LLC’s finances through the owner’s SSN blurs exactly the line between business and personal that the LLC exists to draw. Practically every formation checklist puts the EIN immediately after the state filing. It is the second document your business needs to exist in the financial system.
When do you need a NEW EIN?
- New EIN required: incorporating your sole proprietorship, converting to or from a partnership (adding or losing members changes the tax entity), a corporation created by a statutory merger, or buying a business you will run as a different entity type.
- Same EIN, just notify the IRS: changing the business name, moving addresses, adding locations, or electing S corp status for an existing corporation or LLC. The entity itself did not change.
Quick answers
Can I use my SSN instead of an EIN?
Only as a sole proprietor or single member LLC with no employees, and only for federal taxes. The moment you hire, add a partner, incorporate, or elect corporate taxation, the EIN is mandatory. And the bank wanted it long before that.
Does getting an EIN mean I owe taxes?
No. The EIN is an identifier, not a tax election, and it does not create tax liability by itself. It does set expectations: tell the SS-4 you will have employees, and the IRS will expect employment tax filings.
Can one person have multiple EINs?
One per entity, not one per person. Own three LLCs, get three EINs. But one entity keeps one EIN for life. You never replace it because you misplaced it; that is the 147C letter, covered in the lost EIN guide below.
Do nonprofits need an EIN?
Yes, and before applying for 501(c)(3) status: the IRS exemption application requires an existing EIN.
